Family Matters – Paternity & Adoption Leave

Effective January 1, 2023, biological fathers of newborns, and newly adoptive parents, are now entitled to 20 working days’ paternity and adoption leave with pay.

Paternity Leave

  • Paid leave can only be accessed on three occasions within each government organisation
  • Full-time male employees, 18 years or older with at least 12 months of continuous service whether contracted or in a confirmed post are eligible
  • Part-time employees with at least 12 months of continuous service and who are working at least 18 hours per week are also eligible, granted official documentation is provided proving that he is the registered father of the child
  • Leave will only be granted within the first six months of delivery
  • Multiple births of the same pregnancy (twins, triplets, etc.) will not increase the number of days granted for paternity leave
  • Paternity leave for different pregnancies can only be accessed six months apart
  • Leave may be accessed in the event of stillbirth or the infant’s death within six months after delivery

Adoption Leave

  • This can only be accessed on three occasions within each government organisation
  • Full-time employees aged 18 years or older with at least 12 months of continuous service irrespective of employment types or a combination thereof (e.g., contract to established post or vice versa) are eligible
  • Part-time employees with at least 12 months of continuous service, working at least 18 hours per week are eligible
  • The employee(s) name that appears on the adoption application documents can apply for adoption leave
  • Employees can be granted adoption leave as one full allotment or in two instalments at the request of the applicant
  • The application must also be supported by documents from the Child Protection and Family Services Agency (CPFSA) or the courts
  • Adoption leave can only be accessed once per year and after the placement of a child

In addition to these new entitlements, the Government of Jamaica (GOJ) has extended paid maternity leave from 40 to 60 working days.
