Understanding Child Labour

Child labour is any work or economic activity that deprives children of their childhood, potential and dignity. In 2016, an estimated 38,000 children living in Jamaica were involved in child labour according to the Statistical Institute of Jamaica (STATIN).
The Child Care and Protection Act (2004) (CCPA) is the primary legislation aimed at protecting children from exploitation.
Minimum Age for Employment
The CCPA legislation grants permission for:
• Children older than 15 years to be formally employed once secondary schooling is completed and the child is afforded time for leisure.
• Children 13 to 15 years old to be engaged in light work not exceeding four hours per day and 14 hours per week.
The CCPA defines light work as any activity that is not harmful to a child’s health, does not include harmful chemicals or heavy machinery, and does not impede development and their right to leisure or schooling.
Children should not be made to miss school to do chores or assist with family businesses.
Child Labour Offences
It is a criminal offence to breach the child labour laws. Offences will attract penalties ranging from $250,000 to $1 million in fines or three months’ imprisonment. The Ministry of Labour and Social Security (MLSS) is responsible for enforcing and monitoring compliance with child labour laws.
