Cabinet has given approval for the introduction of a Bill to indemnify the Negril/Green Island Area Local Planning Authority for approvals granted and other acts done in good faith, between March 24, 1984 and the date of the commencement of the Act.
Entitled the Town and Country Planning (Negril Green Island Area Local Planning Authority) (Validating and Indemnity) Act, the Bill will be introduced in the Houses of Parliament and when passed, will sanction the approvals and acts as carried out validly.
Minister with responsibility for Information, Telecommunications and Special Projects, Hon. Daryl Vaz gave details of the Bill from a Ministry Paper, at the weekly post Cabinet press briefing, held at Jamaica House, on July 15.
According to the Ministry Paper, which was tabled in the House of Representatives on July 13, the Bill also provides for every person liable to be charged on the grounds of illegality in the conduct of such approvals and others without lawful authority, to be acquitted, discharged and indemnified.
There is also to be an amendment of the General Notice No. 215 published in the Jamaica Gazette dated Thursday, December 8, 2005 to apply with effect from its date of publication, with reference being made to the ‘Town and Country Planning (Negril Green Island Area) Provisional Development Order (Confirmation) notification, 1984.
Also, there is to be a regularisation of notification appointing the Authority.
